Terms of Service

1. Eligibility and account use

You must be at least 18 years old, or the age of legal majority where you live, to use the Services. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. If you create an account or use the Services on behalf of a company or another person, you represent that you are authorized to bind that party to these terms.

2. What Simply Voiced provides

Simply Voiced helps authors turn manuscripts into audiobooks. Depending on the workflow you choose, the Services may let you:

• create an account with email/password or supported Google sign-in,
• create and manage book projects,
• upload manuscript files in supported formats,
• select a premade voice or submit voice samples for voice cloning,
• pay through Stripe Checkout, and
• generate, review, and download audiobook audio.

We may update, improve, suspend, or discontinue parts of the Services at any time. We may also add or remove features to improve safety, reliability, or legal compliance.

3. Your content and permissions

You retain ownership of the content you submit to the Services, including manuscript text, uploaded files, voice samples, and related materials ("Your Content"). You grant us a non-exclusive, worldwide license to host, store, reproduce, process, and transmit Your Content as needed to operate the Services, including to:

• store and retrieve uploaded files,
• extract and prepare text from your manuscript,
• send text and voice data to providers we use to generate audio or process payments,
• generate audiobook audio and make it available to you, and
• maintain, troubleshoot, secure, and improve the Services.

You represent and warrant that you have all rights, permissions, and consents needed to upload and use Your Content with the Services, including any rights needed to create or request synthesized narration based on a voice.

4. Voice cloning and consent

If you upload voice samples or request cloned narration, you represent that the voice belongs to you or that you have explicit permission from the voice owner to use it for this purpose. You must not upload voice samples or generate audio in a way that infringes another person's rights, impersonates someone without permission, or breaks the rules of our service providers.

We may refuse, suspend, or remove projects involving voice data if we believe additional consent, verification, or review is required.

5. Acceptable use

You may not use the Services to:

• violate any law or regulation,
• infringe intellectual property, privacy, publicity, or other rights,
• misrepresent authorship or ownership of content,
• create defamatory, fraudulent, deceptive, abusive, or harmful audio or text,
• attempt to access accounts, systems, or data without authorization,
• interfere with the operation or security of the Services, or
• use the Services in a way that violates the terms or policies of our vendors, including Stripe or ElevenLabs.

6. Payments, pricing, and refunds

Some features require payment. When you make a purchase, payment processing is handled by Stripe. You agree to pay all charges associated with your selected Services, including applicable taxes and fees. Pricing may change in the future, but those changes will not retroactively alter amounts already charged for completed transactions.

Unless we say otherwise in writing or applicable law requires it, purchases are final and non-refundable. If a payment dispute or chargeback occurs, we may suspend access to the affected project or account while the issue is reviewed.

7. Availability and third-party services

The Services depend on third-party infrastructure and providers, including hosting, storage, payment processing, authentication, and voice generation tools. We are not responsible for outages, delays, feature changes, or policy changes caused by third-party services, although we will try to operate the product responsibly around them.

8. Storage, deletion, and account closure

Your manuscripts and generated audio remain stored until they are deleted. Today, the product does not offer an automatic expiration schedule for book data. If you choose the in-app account deletion option, we will delete your account records and associated stored book files from our application storage, subject to any limited retention we need for legal, tax, fraud-prevention, or dispute-resolution reasons.

9. Intellectual property in the Services

The Services, including our branding, interface design, software, and site content other than Your Content, are owned by us or our licensors and are protected by applicable intellectual property laws. These terms do not grant you ownership of the Services or any rights to copy, reverse engineer, resell, or exploit them except as expressly allowed by law or by our written permission.

10. Feedback

If you send us suggestions, ideas, or other feedback, you allow us to use that feedback without restriction or compensation to you.

11. Disclaimers

The Services are provided on an "as is" and "as available" basis. We do not guarantee that generated audio will be error-free, uninterrupted, suitable for every purpose, or free from provider-side limitations. You are responsible for reviewing your outputs before publishing or distributing them.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising from or related to your use of the Services. To the fullest extent permitted by law, our total liability for claims arising out of or relating to the Services will not exceed the greater of the amount you paid us for the specific Services giving rise to the claim during the 12 months before the claim arose or one hundred U.S. dollars (US $100).

13. Indemnification

You agree to indemnify and hold harmless Simply Voiced and its operators, affiliates, service providers, and personnel from claims, losses, liabilities, and expenses arising out of or related to Your Content, your use of the Services, or your violation of these terms or applicable law.

14. Suspension and termination

We may suspend or terminate your access to the Services if we believe you have violated these terms, created legal risk, harmed other people, or interfered with the product. You may stop using the Services at any time.

15. Changes to these terms

We may update these terms from time to time. When we do, we will update the date at the top of this page. Your continued use of the Services after updated terms become effective means you accept the revised terms.
